Evictions

 

Airfactz has been coordinating evictions in Spokane County for over 15 years.  We can assist you to evict a tenant for lease violations in Spokane County.  Below you will find a brief over view of how the process works and what is involved.

Eviction Fees:  The cost is $800.00 and covers the complete eviction process from start to finish. The eviction fee is non-refundable and due at the time the eviction process is started.

Required Documentation:  When you begin an eviction, it is important that you submit the following:

  1. Eviction Checklist and Contact Form
  2. Sheriff Information Sheet
  3. Copy of the Notice (3, 10, or 20 day) with the declaration of service
  4. Rental Application
  5. Rental Agreement or Lease
  6. Rent ledger if for non-payment

The Eviction Process:  The entire process takes approximately 21 to 35 days.  The process is as follows:

  1. The Eviction Summons and Complaint for Unlawful Detainer in Spokane County Superior Court.  The show cause hearing is set between 10 - 30 days from the filing date.
  2. The Eviction Summons and Complaint for Unlawful Detainer are served to the tenant at least 7 days prior to the hearing.
  3. Both the defendant(s) (the tenants) and plaintiff (you, the landlord) and legal counsel are required to attend the show cause hearing.  The judge will issue a Judgment and Writ of Restitution.
  4. The Spokane County Sheriff will post the Writ of Restitution which instructs the tenant that they must vacate within three days.  After the three days you will be contacted by the Sheriff to schedule the eviction at which time the locks will be changed.
  5. Do a walk through with a checklist, notating all damages and costs incurred.  This amount may also be collected along with the judgment when the account is turned over to a collection company such as Pride Recovery Services.  They can help guide you through the collection process.
